According to the Trading in Public Places Local Law 2008, goods means any  good involved in the contravention that can lead to impounding, and includes - (b) a stall or other structure temporarily placed on land, involved in such as contravention.

A goods display permit allows you to display goods associated with your approved business on the footpath area in front of your premises and you may extend this goods display in front of the adjacent tenanted business, if you have obtained permission from the owner of the business. You may also extend the goods display in front of an adjacent vacant business, if you have obtained permission from the owner of the tenancy.

Before you start your application, there are a few requirements you need to be aware of, including:

  • You will need public liability insurance with a minimum of $10 million coverage that specifically includes using the footpath for this type of activity;
  • Goods displays located on the footpath must be located either within the frontage or kerbside zone (see Fig 1. below);
  • Goods displays associated with a COVID-19 Temporary Parklet must adhere to the COVID-19 Temporary Parklet Guidelines;
  • A minimum 1500mm continuous clear pathway for pedestrians;
  • Frontage zone only if the speed limit on your road is 60km/per hour or more, if your business is on Charles Street and/or you are located within 10 metres of a corner);
  • The goods display must be removed from the footpath at close of business each day;
  • Ensure that the goods are of a stable design and is not readily moved by the wind, and does not cause any hazard or danger to any person using the thoroughfare;
  • Only display goods on a footpath which immediately abuts and not extending more than 1 metre from the building, which is occupied by the owner of the goods or in a location approved by the local government and specified in the permit;
  • Ensure the free passage of persons using the footpath is maintained at all times; and
  • A person shall not cause or permit goods to be displayed in such a condition, which in the opinion of an authorised person, causes or is likely to cause injury or danger to any person or damage to the clothing or possessions of any person.

To submit your online application, you will need to upload the following information:

  • An accurate plan and description of:
    • The proposed goods; and
    • The proposed location of the goods and the area in a radius of approximately 10 metres around the location on a scale of 1:100 the location of all carriageways, footpaths, verges, street furniture, light poles, parking signs, traffic lights, other impediments to pedestrian traffic and premises abutting any verge or footpath;
  • Colour photograph (or similar) of the proposed goods; and
  • Certificate of Currency for minimum $10 million public liability insurance.
