Vincent was the first local government in Western Australia to adopt a policy and online public register of council member contact with developers, and to publish and update an online public register of gifts and hospitality received by Council Members and Staff.

Contact with developers

Council at its meeting on 2 June 2015 adopted Policy No. 4.2.15 - Council Member Contact with Developers to provide guidance on contact between Council Members and Developers operating in the City of Vincent. Under Policy No. 4.2.15, Council Members must record the nature and type of any ‘prescribed contact’ which they have with a developer and provide a copy of that record to the CEO within 10 days of the contact occurring.

Council member sitting fees

Council Member fees and allowances are determined by the salaries and allowances tribunal according to 'band' classification for local governments in Western Australia. The City of Vincent is classified by the tribunal as a 'band 2' local government.

Mindarie Regional Council

The City of Vincent is currently represented on the Mindarie Regional Council (MRC) by Cr Alex Castle, following the resignation of Mayor Emma Cole from 1 July 2021.

Allowances payable to Council Members of the MRC are specified in MRC Policy “CP01 - Annual Fees, Allowances and Expenses for Councillor”, which in turn is based on the SAT determination for Elected Members.

In 2019/20, MRC Council Members are paid:

  • $10,300 – Annual Member Sitting Fee
  • $1,000 – Annual Information Technology Allowance
  • $140 - Sitting fee per meeting for Alternate Member attendance
  • Child Care and Travel costs will be reimbursed in accordance with Reg. 31 and 32 of the Local Government (Administration) Regulations 1996.

Tamala Park Regional Council

The City of Vincent is currently represented on the Tamala Park Regional Council by Mayor Emma Cole and the Alternate Member is Cr Joanne Fotakis.

Allowances payable to Council Member of Tamala Park Regional Council (TPRC) are based on the SAT determination for Elected Members.

In 2019/20, Tamala Park Regional Council Members are paid:

  • $10,455 – Annual Sitting Fee
  • $0 - Sitting fee per meeting for Alternate Member attendance

Metro West Joint Development Assessment Panel

The City of Vincent is currently represented on the Metro West Joint Development Assessment Panel by Cr Dan Loden and Cr Joshua Topelberg.  Cr Susan Gontaszewski and Cr Ashley Wallace are the respective Alternate Members.

Allowances payable to Development Assessment Panel Members are prescribed in the Planning and Development (Development Assessment Panels) Regulations 2011 - Schedule 2, which can be found at https://www.slp.wa.gov.au/legislation/statutes.nsf/main_mrtitle_12173_currencies.html.

There are a number of fees set out in Schedule 2, however Meeting Fees for Council Members are:

  • $400 – per meeting

Gifts

It is the City’s position that any gift received (and not able to be returned) by a council member and valued above $50 is to be disclosed and included in the City’s Register of Gifts. This requirement goes beyond the legislative requirement, which requires disclosure of gifts above $300 only.

An invitation or ticket to an event provided directly to an individual (which means personally to an Elected Member or the CEO) is to be treated as a gift (gift as defined in section 5.57 of the Act).

Elected Members or the CEO may accept these invitations, subject to disclosing the acceptance of the invitation / ticket as a gift (if valued at over $50, in accordance with the City’s Governance Framework. The gift will be disclosed on the City’s public Register of Gifts.

An Elected Member or the CEO may attend an event and not disclose it as a gift if they have purchased the ticket themselves.

Interests disclosed at Council meetings

Council at its meeting on 5 April 2016 resolved to create and publish an online register of Financial, Proximity and Impartiality Interest disclosed by Council Members and Staff at Ordinary and Special Council Meetings commencing from February 2016.  The Local Government Act 1995 (Section 5.66) deals with the disclosures of interest in any matters before Council.

Primary and annual returns

The Local Government Act 1995 requires Council Members and employees to make decisions in the best interests of the community and decision-making must be transparent, accountable and free from bias or conflicts of interest. In view of this, elected members and employees (with delegated authority) must disclose certain personal information when they commence and every subsequent year while either elected, or employed at the City. These disclosures are called “primary returns” and “annual returns”.

A primary return is a snapshot of personal financial information as it exists upon the start date of an elected member or an employee.

An annual return retrospectively discloses any changes to the information previously disclosed, or any new interest information to disclose since completing their last return.

In accordance with the Local Government Act 1995 and the Local Government (Administration) Regulations 1996 local governments are required to publish a list of elected members and employees (by position) that lodged a primary return and annual return for each financial year, commencing after 1 July 2020.
